Privacy policy

When processing personal data, the controller shall comply with the following legal provisions:
- Act No. 18/2018 Coll. on the Protection of Personal Data
- Regulation (EU) 2016/679 of the European Parliament and of the Council ("GDPR")


We treat your personal data professionally and sensitively.
- We do not disclose it to third parties in any case (except to the extent necessary for the delivery of goods or, exceptionally, for the purpose of asserting our claims or for the fulfilment of legal obligations, as the case may be).
- They are stored in a secure database with the need for authorised access.
- Your data is encrypted on the way to our server, so that no one can decrypt it on the way. We declare that all our systems are protected against misuse of personal data and all personal data is kept strictly confidential.
- All Moitin Ltd personnel who come into contact with your personal data have been properly instructed in the proper and sensitive handling of it.

- When you pay online using payment systems, you enter all your details on the bank's secure website.
- We do not come into contact with your sensitive payment data - we only learn the successful or unsuccessful outcome of the transaction.

Purpose of personal data processing
- Issuing a tax document - invoice, within the meaning of Act 222/2004 Coll. on value added tax, § 71
paragraph 2 letter b).
- Delivery of goods and identification of the customer before handing over the prepaid goods.
- Purchase of goods and/or services - order confirmation, payment for goods, delivery of ordered goods - by telephone and by e-mail.
- Recording of customers for the purpose of maintaining their user accounts on www.modelsnavigator.com
- Recording of customer orders for the resolution of any complaints.
- Sending informative electronic messages if the customer expresses interest in this service.
- Exercise of rights and legal claims and control by public authorities - if we need the data to exercise our rights and legal claims (e.g. if you have an outstanding obligation to us). Furthermore, we may also process your personal data because we need it for the purposes of inspections by public authorities.


Legal basis for processing personal data
Your personal data is processed in accordance with the following legal bases:
a. The processing of your personal data is necessary for the performance of a contract to which you are a party as a data subject or in order to carry out pre-contractual measures at your request as a data subject (processing your order, conclusion and performance of a sales contract);
b. the processing is also necessary for compliance with a legal obligation of the controller (bookkeeping and related activities) and/or
c. the processing of your data is necessary for the purposes of the legitimate interests pursued by the controller (marketing purposes - interest in the promotion of the controller, its products and services).

  • Information about your orders - for the purpose of processing them and resolving any complaints.

Necessity to provide personal data
- The controller only obtains the personal data that is necessary for the fulfilment of the obligations that the customer expects from him by ordering the goods. Without this data, it will not be possible to process the order received. For this reason, the customer is obliged to fill in all the required data when placing an order. In the case of the need to provide the above personal data, this is a requirement that is necessary for the conclusion of the contract between the seller and the buyer.


Third parties to whom the data will be disclosed
We do not provide personal data to any companies managing personal data databases or to any other third parties, except to the extent necessary for the delivery of goods:
- Partner courier companies:
o Slovak Parcel Service, s.r.o. (authorized UPS contractor), Senecká cesta 1, 900 28 Ivanka pri Dunaji ID No.: 31 329 217;

- Scope of provided data: name and address of the recipient, delivery address, telephone number of the recipient, e-mail address of the recipient, total price of the order in case of payment on delivery.
- In exceptional situations, another courier company may be selected to deliver the goods by operational decision. Due to the operational nature of the decision, it is not possible to determine the name and registered office of the company in question in advance.


Other categories of potential recipients of personal data:
- Tax authorities
- State administration and public authorities for control and supervision (e.g. SOI)
- Statistical office,
- Courts, law enforcement authorities, administrative authorities
- Bailiffs
- Banks, insurance companies
- Entities providing external accounting services
- Service centre, vendor's supplier (for complaint purposes)
- Law firms (if necessary to exercise our rights)


Rights and obligations of the data subject
- The customer is obliged to provide only complete and truthful data.
- The Customer undertakes to update his/her data in the event of a change and at the latest before the first order following the change is executed.
- The Customer undertakes that if he/she provides personal data of a third party as data for delivery (name, surname, telephone number), he/she does so only with his/her consent and that the person concerned is aware of the procedures, rights and obligations set out on this page.


We are ready to exercise your rights when processing your personal data:
- You have the right of access to your personal data, as well as the right to know for what purpose it is processed, who the recipients of your personal data are, what is the duration of the processing.
- You have the right to rectification, if your personal data is incorrect or has changed, please contact us, we will correct it.
- You have the right to have your personal data erased if it is no longer necessary for the purposes for which it was processed or if it is processed unlawfully.
- If your personal data is processed on the basis of consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent given prior to its withdrawal.
- You have the right to restrict processing if you wish us to process the data only for the most necessary lawful reasons, or not at all.
- You have the right to object and the right not to be subject to automated individual decision-making if you find or believe that such processing is unlawful or contrary to your rights.
- You have the right to data portability, if you wish to transfer your data to another controller, we will provide it to you in an appropriate format, unless other technical or legal obstacles prevent this.

Further conditions for the exercise of the individual rights, as well as the related exceptions and limitations, follow from the relevant provisions of Articles 15-22 GDPR.
You also have the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic, located at Hraničná 12, 820 07 Bratislava 27, Slovak Republic, ID No: 36 064 220, tel.: +421 2 3231 3220, https://dataprotection.gov.sk/uoou/
Consent to the processing of personal data may be revoked by the purchaser at any time in writing; the above applies provided that the personal data was processed on the basis of the consent of the data subject. Consent will expire within 1 month of receipt of the withdrawal of consent by the buyer to the seller and the data will subsequently be deleted, unless there is no other legal basis for the processing and/or one of the exceptions in accordance with Article 17(3) GDPR.
The modification of the personal data can be carried out by the data subject manually in the "change personal data" item, which is located in the menu after the customer login.

All legitimate requests made by the data subject will be complied with and the data subject will be informed of this within 30 days of receipt.
The Customer may exercise the rights by e-mail to info@modelsnavigator.com or in writing to the registered office of Moitin s.r.o., Miletičova 5B, 82108 Bratislava.


Retention period of personal data
Personal data will be kept:
a. At least for the entire duration of the contractual relationship between the Seller and the Buyer or, with regard to the exercise of any claims, for a period of four (4) years from the termination of the contractual relationship;
b. in the case of processing of personal data for which consent has been given, we will process such personal data for a period of two (2) years or until the consent is withdrawn;
c. we will process personal data that are necessary for the proper performance of legal obligations for the period specified by the applicable law (e.g. tax documents for 10 years).


Advertising
- Third party vendors, including Google, display our advertisements on the internet.
- Third party vendors, including Google, use cookies to serve ads, based on a user's previous visits to our website.
- Users can opt-out of Google's use of cookies by visiting the Google Advertising opt-out page.


Final provisions
As the controller, we do not intend to transfer your personal data to a third country or international organisation.
Personal data of persons under the age of 16: Our online shop is not intended for children under the age of 16. A person under the age of 16 may only use our online shop if his or her legal guardian gives consent to do so.
